Legal
Terms and Conditions
Effective date: 31 October 2026
By using the services of Forever Linked (“we”, “us” or “our”), you agree to these Terms and Conditions. They form a legally binding agreement between you and Forever Linked and govern your use of our services. Please read them before booking or buying.
1. Services provided
We specialise in permanent jewellery, including bracelets, anklets, necklaces and other custom pieces, made from high quality materials such as 925 sterling silver and 14k gold-filled chain.
Services are provided across Australia at:
- public shows, festivals, markets and pop-ups; and
- private events such as parties, hens and bridal celebrations and corporate functions.
Each piece is custom fitted to your wrist, ankle or neck and welded on site using a safe, precise welding process, giving a secure, clasp-free finish intended for long-term wear. We perform all services with due care and skill and follow industry safety standards and best practice.
2. Shows and private events
Shows are walk-in only. At public shows and festivals there are no bookings: service is first come, first served while stock and time allow. Show dates and locations are listed on our Shows page and social media. Please confirm details before you travel; you are responsible for your own transport, parking and any event entry fees.
Private events are booked by enquiry. To book a private event, send an enquiry through our private events page or email us. Section 3 explains how a booking is confirmed.
We are not responsible for inconvenience or costs caused by changes to or cancellation of a public event that are beyond our control (see section 15).
3. Private events
3.1 How a booking is confirmed
After you enquire, we send you a written quote setting out the date, time, location, minimum spend, any travel fee, the deposit and what we need on the day. Your booking is confirmed only once you have accepted the quote and we have received your deposit. Until then the date is not held for you.
3.2 Deposit
A deposit secures your date. The amount is shown in your quote. On the day, the deposit counts towards the minimum spend. If your guests' own purchases reach the minimum spend without it, your deposit is yours to use as credit for pieces for yourself or your guests on the day, or we refund it within 7 days, whichever you prefer.
3.3 Minimum spend and the balance
Private events have a minimum spend, set out in your quote. Your guests pay for their own pieces on the day unless you have arranged to cover them. If the total spent by guests, plus your deposit, is less than the minimum spend, you can either pay the difference or use it as credit for pieces you gift to guests or yourself on the day.
The difference (if any) and any travel fee make up the balance, which the host pays at the end of the event using any of the payment methods in section 5.
3.4 Travel fees
Travel fees depend on where your event is (see the table on our private events page) and are set out in your quote. Interstate travel may cost less, or nothing, when your event lines up with a show we are already attending.
3.5 Cancelling or rescheduling
If you need to cancel or reschedule, please tell us in writing as early as possible. If you give at least 14 days' notice, you can choose to move your booking to another available date or to have your deposit refunded. The first move is free and your deposit carries over to the new date; after that we treat a further change as a new booking, and your deposit still carries over to it. With less than 14 days' notice, we may keep the deposit to cover the time we reserved and costs already spent (such as non-refundable travel). If we manage to rebook your date, we refund your deposit less any costs already spent, and we will always tell you what we kept and why.
If we need to cancel or reschedule (for example because of illness or an emergency), we will tell you as soon as possible and offer you a new date. If no new date suits you, we refund everything you have paid us for the event in full.
3.6 What the host provides
Your quote lists what we need on the day. Usually that is:
- a table and a chair;
- access to a standard power point near the table; and
- good light, ideally natural light or a well lit room.
Please also give us safe access to set up before guests arrive, and tell us about any parking or access arrangements.
3.7 Weather and venue issues
Welding cannot be done in rain or strong wind, so outdoor events need a covered, dry spot. If something on the day makes welding unsafe or impractical, we will first work with you to fix it, for example by moving indoors.
- If service cannot go ahead because a requirement listed in your quote was not met and could not be fixed on the day, it counts as a cancellation by the host with less than 14 days' notice. Only the deposit is affected; you do not pay any minimum spend shortfall.
- If service cannot go ahead because of something neither of us controls, such as a power outage or weather too severe for a covered setup, section 15 applies.
3.8 Your rights
Nothing in this section limits your rights under the Australian Consumer Law. If our services are not provided with due care and skill, you are entitled to the remedies described in section 7.
4. Customer conduct and refusal of service
We want every service to be safe, respectful and enjoyable for everyone. Please treat us and others with courtesy, follow instructions during fitting and welding, and do not disrupt the event or compromise safety.
We may refuse service, or stop a service, if you:
- behave in a disrespectful, abusive, threatening or aggressive way towards us or others;
- are visibly intoxicated or affected by drugs to a degree that makes service unsafe;
- do not follow safety instructions, putting yourself or others at risk; or
- breach event rules set by the organisers.
This right is exercised reasonably and in line with Australian law, and does not affect your rights under the Australian Consumer Law.
5. Payment terms
- Payment timing: at shows, full payment is required before your jewellery is welded. For private events, payment follows section 3.
- Accepted methods: we accept cash, credit and debit cards, Afterpay and other methods shown at each event.
- Pricing: all prices are in Australian dollars and include GST where applicable. Prices may vary with material, design and event-specific offers.
- Adjustments: we may change prices or offer promotions. The price shown at the time of service applies, except that for a confirmed private event the prices in your quote apply.
- Refunds: our refunds follow the Australian Consumer Law. See section 7 and our Refund Policy.
6. Warranty and liability
Weld guarantee: if a weld breaks because of a defect in materials or workmanship within 14 days of purchase, we will repair or replace it at no cost, provided you show proof of purchase (such as a receipt or booking confirmation). This guarantee is in addition to your rights under the Australian Consumer Law, which are not limited to 14 days: a weld that fails because of a defect is repaired free whenever that happens. See our Refund Policy for how to claim.
The weld guarantee does not cover:
- damage to chains, charms or components from misuse, accidents or normal wear and tear; or
- breakage caused by excessive force, improper handling or external factors such as catching on objects.
Quality check: every piece is strength tested before you leave to make sure it meets our standards.
Re-weld service: if your weld or chain breaks through wear and tear, accident or misuse, or for jewellery not bought from us, we offer a re-weld for $25, subject to availability at our events. The fee never applies to a break caused by a defect.
Liability: to the extent permitted by law, our liability for any claim relating to our services is limited to the cost of the service provided, except where loss is caused by our negligence or wilful misconduct. We are not liable for allergic reactions, skin irritation or other health issues related to the materials or welding process unless caused by our negligence, or for injury or damage resulting from misuse or not following care instructions. This does not exclude, restrict or modify any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
7. Consumer rights
Nothing in these Terms overrides your rights under the Australian Consumer Law or other applicable law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and our services are guaranteed to be provided with due care and skill. If we fail to meet these guarantees:
- Goods: for a major failure you can choose a replacement or a refund. For a failure that is not major, we will fix it within a reasonable time, for example by repairing the item.
- Services: for a major failure you can cancel and get a refund for the unused portion, or compensation for the drop in value. For a failure that is not major, we will fix the problem within a reasonable time.
- You are also entitled to compensation for any other reasonably foreseeable loss or damage caused by the failure.
Please contact us if you believe your consumer rights have not been met.
8. Safety and procedure
Welding is carried out by a trained operator using safe, industry standard equipment. Risks are minimal, but can include slight skin irritation or discomfort from the welding spark, and, rarely, minor burns if safety instructions are not followed.
Please tell us about any metal allergies, skin sensitivities or medical conditions before we start, and follow the instructions we give you. We are not liable for health issues unless caused by our failure to take due care.
9. Event rules and regulations
You must follow the rules set by event organisers, including health and safety requirements, entry conditions and venue behaviour rules. Not following them may lead to refusal of service. We are not responsible for consequences or costs that result from not following event rules.
10. Privacy
We handle your personal information in line with our Privacy Policy and the Privacy Act 1988 (Cth). We use your name, contact details and payment information to provide our services, process bookings and payments and, with your consent, send you marketing. You can ask to access, correct or delete your information at any time by contacting us.
11. Intellectual property
All Forever Linked content, including designs, logos, website material and promotional content, is our intellectual property and is protected under Australian law. Please do not reproduce or use it without our written permission, except for personal, non-commercial use such as sharing a photo of your jewellery with credit to us.
12. Social media and photography
We may photograph or film our jewellery and customers at events for marketing, such as social media, our website and advertising. If you would prefer not to be included, tell us before or during your service. We will make reasonable efforts to leave you out, though we cannot guarantee it in group or background shots.
13. Governing law and dispute resolution
These Terms are governed by Australian law, and disputes are subject to the jurisdiction of Australian courts. If a disagreement arises, please contact us first so we can try to resolve it informally. If it is not resolved, either of us may suggest mediation before taking legal action.
14. Amendments
We may update these Terms to reflect changes to our services or the law. Updates are posted on this page with a new effective date. A confirmed private event booking is governed by the Terms in place when your booking was confirmed.
15. Force majeure
We are not liable for delays, cancellations or failure to provide services caused by events beyond our reasonable control, such as natural disasters (including floods and bushfires), pandemics or government restrictions, severe weather or power outages. If this happens, we will offer a new date or, if you prefer, a refund of amounts you have paid for services we could not provide.
